1. Acceptance of Terms

By accessing and using The Hourly Studio platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

The Hourly Studio provides a platform that connects licensed healthcare providers with professional studio spaces for aesthetic and medical procedures. Our services include:

  • Studio space rental and booking management
  • Provider verification and credential management
  • Payment processing and billing
  • Communication tools between providers and clients
  • Compliance monitoring and reporting

3. Provider Eligibility and Requirements

3.1 Professional Requirements

To use our platform as a provider, you must:

  • Hold a valid, active professional license (MD, NP, PA, RN)
  • Maintain current malpractice insurance ($1M/$3M minimum)
  • Possess current BLS/ACLS certification (as applicable)
  • Complete OSHA Bloodborne Pathogens training
  • Provide proof of supervising physician/protocols (if applicable)
  • Maintain DEA registration (if applicable to practice)

3.2 Application Process

All providers must complete our application process, including submission of required documents and verification of credentials. We reserve the right to approve or deny applications at our sole discretion.

4. Studio Usage and Booking

4.1 Booking Terms

  • Studio bookings are subject to availability
  • Minimum booking duration may apply
  • Advance booking requirements may be in effect
  • All bookings are non-transferable

4.2 Usage Guidelines

  • Studios must be used only for approved medical/aesthetic procedures
  • Providers must maintain professional standards at all times
  • Equipment must be used according to manufacturer guidelines
  • Studios must be left clean and in good condition
  • Any damage must be reported immediately

5. Payment Terms

5.1 Pricing and Billing

  • Studio rental rates are per hour and subject to change
  • Payment is required at the time of booking
  • Additional fees may apply for extended hours or special equipment
  • All prices are exclusive of applicable taxes

5.2 Refund Policy

  • Cancellations made 24+ hours in advance: Full refund
  • Cancellations made 2-24 hours in advance: 50% refund
  • Cancellations made less than 2 hours in advance: No refund
  • No-shows: No refund
  • Emergency cancellations may be considered on a case-by-case basis

6. Compliance and Legal Requirements

6.1 Healthcare Regulations

Providers using our platform must comply with all applicable healthcare regulations, including:

  • State medical practice acts
  • HIPAA privacy and security requirements
  • OSHA workplace safety standards
  • FDA regulations for medical devices
  • Professional licensing board requirements

6.2 Controlled Substances

The Hourly Studio does not store or provide controlled substances. Providers must handle all medications and controlled substances according to applicable laws and regulations. We do not assume responsibility for any controlled substance violations.

7. Liability and Insurance

7.1 Provider Liability

Providers are solely responsible for:

  • All medical procedures performed in our studios
  • Patient care and outcomes
  • Maintaining adequate malpractice insurance
  • Compliance with all applicable laws and regulations
  • Obtaining informed consent from patients

7.2 Studio Liability

The Hourly Studio provides studio space and basic equipment only. We are not responsible for medical outcomes, patient care, or any issues arising from procedures performed by providers using our facilities.

8. Prohibited Activities

The following activities are strictly prohibited:

  • Practicing without a valid license
  • Performing procedures outside your scope of practice
  • Using expired or unapproved medications
  • Violating patient privacy or confidentiality
  • Engaging in fraudulent billing practices
  • Misrepresenting credentials or qualifications
  • Sharing account access with unauthorized persons

9. Account Suspension and Termination

9.1 Suspension

We may suspend your account for:

  • Violation of these terms and conditions
  • Expired licenses or certifications
  • Non-payment of fees
  • Complaints or safety concerns
  • Failure to maintain required insurance

9.2 Termination

We reserve the right to terminate accounts for serious violations, repeated violations, or any activity that poses a risk to patient safety or platform integrity.

10. Intellectual Property

The Hourly Studio platform, including its design, functionality, and content, is protected by intellectual property laws. Users may not copy, modify, or distribute any part of our platform without written permission.

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using our service, you consent to the collection and use of information as described in our Privacy Policy.

12. Dispute Resolution

Any disputes arising from these terms or your use of our service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in New York, NY.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through our platform. Continued use of our service after changes constitutes acceptance of the new terms.
